Legal: Will the New No-Match Rule Take Effect?
Proposed changes to the Homeland Security Departments (DHS) no-match regulations will create a no-win situation where employers must choose between facing liability for civil and criminal violations of immigration law or costly discrimination and wrongful discharge litigation. This is the view from panelists during an American Bar Association (ABA) teleconference. However, legal challenges are delaying the implementation of the rule, so HR professionals need to stay tuned on this issue.
