Workplace Violence: Dealing with Problem Employees Under ADA and Privacy Requirements

When is it?

  June 4, 2008 at 02:00PM ET

Recent violence at U.S. businesses—like the three separate workplace shooting incidents that all took place on April 1, 2008—remind all employers just how crucial it is to mitigate the threat of violence in the workplace.

But, even persons who appear to be potentially-dangerous have rights. These at-risk employees are covered under laws such as ADA, privacy, HIPAA and many state laws. This audio conference will spell out what these laws say and why you can’t afford to ignore them.

According to the US Dept. of Justice, 1.8 million employees are assaulted in the workplace annually. Sixteen workplace assaults have resulted in deaths in the past year.

Despite an obligation to protect employees, employers must clearly understand the legal complexities and risks involved. How does an organization watch for signs that an employee could possibly be violent—without over-reacting and over-stepping the employee’s rights?

Join IOMA and learn about the risks inherent in violence prevention in the workplace. You’ll get advice on how to establish and enforce standards of conduct for employees, as well as ways to avoid the legal and financial risks of workplace violence.

In just 90 minutes, you’ll learn:

  • Methods to better assess the potentially violent individual
  • How to respond to threats of violence and defuse potentially dangerous situations
  • When to use performance management as prevention
  • How to deal with possibly dangerous employees without violating their rights under ADA and state laws
  • The best strategies for disciplining or firing workers with violent tendencies
  • How not to overreact to the threat of violence
  • How to define workplace violence and hostility

You'll also have an opportunity to ask questions in our interactive Q&A portion of the program.
